The website notariuspublic.com is owned and operated by Apostille Worldwide Sl., a company incorporated in Spain, duly licensed under Professional license № 20191219, with its registered office at CALLE VASCO NUÑEZ DE BALBOA, 3, ESTEPONA, 29680, Málaga, Spain. By accepting these Terms & Conditions (hereinafter the “Agreement”), you (the user of the website, hereinafter the “Client”) enter into a legally binding contract with the Service Provider (Apostille Worldwide Sl.). Individually, the Client and the Service Provider may be referred to as a “Party,” and collectively as the “Parties.”

Any person who registers for and applies for services via notariuspublic.com is deemed to have read, understood, and accepted these Terms & Conditions, including the Privacy Policy and the terms of personal data processing.

1. Definitions

For the purposes of this Agreement:

  • Website refers to the online platform located at notariuspublic.com.

  • Agreement refers to this Terms & Conditions document.

  • Starting Date means the date on which the Client accepts this Agreement.

  • Company refers to the legal entity the Client intends to incorporate using the Services.

  • Platform refers to the website on which the services are listed, managed, and provided, and which is owned and operated by Apostille Worldwide Sl.

2. Obligations of the Service Provider

2.1. The Service Provider agrees to deliver the services described in Section 4 of this Agreement (the “Services”). 2.2. The Service Provider will maintain regular communication with the Client throughout the term of the Agreement and will perform the Services with due care and within reasonable timeframes.

3. Obligations of the Client

3.1. The Client shall initiate the service request by completing the online order form on the Platform, providing a valid phone number and email address, and selecting the desired service. 3.2. Upon payment, the Client will be redirected to a biometric identification process powered by a third-party provider. The Client must complete this identification step for the service to proceed. 3.3. Following successful biometric verification, the Client will be directed to submit all required supporting documentation via the designated form. The Service Provider will commence work only upon receipt of all requested documents in an acceptable format. 3.4. The Client acknowledges that the payer of the service may differ from the end recipient. However, the identity of the end recipient must be verified, and all submitted documents must match the verified identity. 3.5. The Client is responsible for ensuring that all submitted information and documentation are accurate, valid, and compliant with the legal requirements of the relevant service. The Service Provider reserves the right to reject incomplete or non-compliant submissions.

4. Services and Terms of Provision

4.1. Online Notary Services 4.1.1. Certified True Copy of Document

Scope of Service:

  • Review of the document submitted by the Client.

  • Remote identity verification using biometric KYC tools.

  • Certification of the document as a true copy by an EU-licensed notary public.

  • Delivery of the notarized copy to the Client via email (PDF). Physical delivery may be requested separately. 

Turnaround Time: Standard processing time is 24 hours (excluding weekends and public holidays) after identity verification and submission of all required documents.

Supported Countries:

  • Certified by an EU notary public and legally valid in Hague Apostille Convention member states.

  • Within the EU, may be accepted without an apostille, depending on the receiving authority’s requirements.

  • The Client is responsible for confirming whether an apostille or additional legalization is required. 

Payment Terms:

  • Total cost: €100.

  • Refunds are available only until the digital delivery of the certified copy. Once sent, the service is non-refundable. 

Client Responsibilities:

  • Provide a legible, valid document and government-issued ID.

  • Ensure the document is certifiable and relevant for its intended use. 

Disclaimers:

  • The Service Provider does not modify or verify the content of submitted documents.

  • Certification is at the notary’s discretion and may be denied if legal/technical standards are not met.

  • Acceptance by individual institutions cannot be guaranteed. 

4.1.2. Signature Notarization

Scope of Service:

  • Secure biometric identity verification.

  • Arrangement of a remote online session with an EU notary public.

  • Live certification of the Client’s signature.

  • Digital delivery of the notarized document (PDF) via email. 

Turnaround Time: 24 to 48 hours after identity verification and document submission.

Supported Countries & Client Requirements: (Same as 4.1.1.)

Payment Terms & Refunds: Service fee: € 100. Refunds only before digital delivery; thereafter non-refundable.

Limitations & Disclaimers:

  • Applies only to the version of the document submitted.

  • No legal review of content.

  • Not available for documents requiring in-person appearance.

  • Final acceptance rests with the receiving authority. 

4.1.3. Power of Attorney (PoA) Notarization

Scope of Service:

  • Secure biometric identity verification.

  • Arrangement of a remote online session with an EU notary public.

  • Live certification of the Client’s POA.

  • Digital delivery of the notarized document (PDF) via email. 

Turnaround Time: 24 to 48 hours after identity verification and document submission.

Supported Countries & Client Requirements: (Same as 4.1.1.)

Payment Terms & Refunds: Service fee: € 100. Refunds only before digital delivery; thereafter non-refundable.

Limitations & Disclaimers:

  • Applies only to the version of the document submitted.

  • No legal review of content.

  • Not available for documents requiring in-person appearance.

  • Final acceptance rests with the receiving authority. 

4.1.4. Notarial Translation

Scope of Service:

  • Secure biometric identity verification.

  • Arrangement of a remote online session with an EU notary public.

  • Live certification of the sworn translation.

  • Digital delivery of the notarized document (PDF) via email. 

Turnaround Time: 24 to 48 hours after identity verification and document submission.

Supported Countries & Client Requirements: (Same as 4.1.1.)

Payment Terms & Refunds: Service fee: € 100. Refunds only before digital delivery; thereafter non-refundable.

Limitations & Disclaimers:

  • Applies only to the version of the document submitted.

  • No legal review of content.

  • Not available for documents requiring in-person appearance.

  • Final acceptance rests with the receiving authority. 

5. Verification Policy

5.1. Measures: Biometric checks, fraud detection, international database screening. 5.2. Consequences: Service denial upon failure; no refunds in case of proven fraud; cooperation with authorities as required.

6. Duration, Charges and Payment Terms

6.1. Duration: Effective from acceptance until cancelled by the Client with 30 days’ notice via email. Outstanding obligations remain due through the cancellation date. 6.2. Charges: Client agrees to pay all service fees, taxes, and mandatory government charges as presented. Payment confirms acceptance of these Terms.

7. Refund Policy

7.1. General: No refunds for delays due to government, compliance, or Client-caused issues. 7.2. Scope: Refunds cover only the paid amount, without interest or additional damages. 7.3. Exclusions: Non-refundable once service is delivered or marked non-refundable; fraud-related denials. 7.4. Method: Refunds to the original payment method. Crypto refunds only within 90 days and require wallet details.

8. Representations and Warranties

Each Party represents that they have full legal capacity to enter into this Agreement, which constitutes a binding obligation, and that all provided information is accurate.

9. Compliance with Laws

Both Parties will comply with all applicable laws and regulations in performing their obligations under this Agreement.

10. Confidentiality

Both Parties agree to keep non-public information confidential for two years post-termination, except as required by law.

11. Force Majeure

Neither Party is liable for delays due to events beyond reasonable control (e.g., war, strikes, pandemics). Notice of such events must be given within 10 days. If they persist over 60 days, either Party may terminate.

12. Dispute Resolution and Applicable Law

12.1. Disputes will first be addressed amicably in writing. 12.2. Governed exclusively by Portuguese law. 12.3. Jurisdiction: courts of Portugal, unless mandatory rules dictate otherwise.

13. Final Provisions

13.1. Use of the Platform binds the Client to these Terms. 13.2. The Service Provider may delegate performance to vetted third parties. 13.3. The Service Provider may modify these Terms at any time; Clients will be notified via email or a website notice.

14. Intellectual Property Rights

All content on notariuspublic.com is the Owner’s exclusive property, protected by copyright and other IP laws.

14.1. All Rights Reserved: No rights are granted except as necessary to use the Platform. 14.2. Restricted Use: Users may not copy, modify, or commercialize content. 14.3. Permitted Personal Use: Downloading or printing for personal, non-commercial use is allowed if copyright notices remain intact. 14.4. Legal Exceptions: Statutory exceptions (e.g., fair use) remain unaffected.
